This yearbook contains summary records of the 2042nd to 2094th meetings of the 40th session of the International Law Commission held May 9 through July 29, 1988 in New York.
Abstract
The Commission adopted an agenda including the organization of the work of the session, State responsibility; jurisdictional immunities of States and their property; and the status of the diplomatic courier and the diplomatic bag not accompanied by diplomatic courier. Also adopted were the Draft Code of Crimes against the Peace and Security of Mankind, the law of the non-navigational use of international watercourses, covering pollution of the watercourse systems, protection of the environment, and pollution or environmental emergencies and the international liability for injurious consequence arising out of acts not prohibited by international law. Relations between States and international organizations, programs and procedures of the commission and its documentation, cooperation with other bodies, and the date for the 41st session were also passed.
