Drug abuse prevention and drug testing programs involve a risk of substantial legal liability when conducted improperly or in violation of Federal, State, and local laws, and employers are advised to consult with legal counsel and other relevant professionals.
Abstract
Drug abuse costs employers about $60 billion a year, and the human loss and suffering are incalculable. To help employers deal with drug abuse in the workplace in accordance with a proper legal framework, the U.S. Chamber of Commerce has developed guidelines that can be modified to fit the specific capabilities, needs, and conditions of both employers and employees. The guidelines consider the extent of the drug abuse problem, drug prevention, commonly asked questions about drug testing, drug-related workplace accidents, employee assistance, dangerous drugs, alcohol abuse, and drug effects. A supervisor's checklist to aid in dealing with a workplace drug incident and procedures to guide who and when to test for drugs are offered. Appendixes contain a list of additional information sources, tollfree telephone numbers for drug abuse counseling and assistance, a list of State agencies dealing with drug abuse, a list of States mandating health benefits for employees with drug or alcohol abuse problems, and sample company policy and authorizations.
