This booklet presents the text of the Council of Europe's Convention on the Transfer of Sentenced Persons, which pertains to inmate exchanges among signatory countries.
Abstract
The general principles of the convention require that the signatories afford each other the widest measure of cooperation in the transfer of sentenced foreign nationals in accordance with convention provisions. Under the convention, a person sentenced in the territory of a signatory may be transferred to the territory of another signatory to serve the sentence imposed. To that end, the offender may express an interest in a transfer either to the sentencing State or the administering State. Transfer may also be requested by either the sentencing State or the administering State. Other convention articles detail the conditions and procedures for transfer. Some of the topics addressed in the articles are the obligation to furnish information, requests and replies, supporting documents, consent and its verification, the effect of transfer for the sentencing State and the administering State, continued enforcement, and conversion of sentence.
