This DWI (driving while intoxicated) manual for Minnesota prosecutors examines DWI developments and legislative updates, traffic law affected by the 1990 Minnesota legislature, Minnesota rules relevant to hazardous substances, and DWI cases.
Abstract
The first part focuses on the Omnibus DWI Bill which contains articles on administrative plate impoundment, expanded DWI sanctions for repeat offenders, criminal vehicular homicide, alcohol-related offenses, and aircraft DWI. The second section discusses traffic law and specifically looks at motor vehicle drivers under the influence of alcohol or controlled substances, alcohol-related driving by commercial vehicle drivers, out-of-service orders, the Open Bottle Law and penalties, and chemical tests for intoxication. The third section deals with Minnesota rules on hazardous substances, and a table of such substances is provided. Federal and State DWI cases are cited, along with DWI implied consent cases. The DWI implied consent cases provide information on investigatory, pretrial, and trial procedures and on constitutional issues in DWI testing and arrests. The manual concludes with a synopsis of selected DWI cases.
