North Carolina's Sentencing and Policy Advisory Commission has reviewed the proposals of the State's 11- member Restitution Subcommittee and on April 22, 1994 adopted 15 recommendations that, taken together, provide a comprehensive strategy to improve crime victim restitution in North Carolina.
Abstract
Recommended actions include the development of a standard form or standard information to address victim impact, legislation to require prosecutors to obtain and present to the court victim impact statements in all felony cases and serious misdemeanor cases, explicit policies and procedures to assess the defendant's ability to pay restitution, and legislation to make the ordering of restitution a priority in all cases where it is appropriate. Other recommendations include making restitution the first priority among all funds disbursed by the clerk of the court, procedures to share automated information with the Division of Adult Probation and Parole, improved enforcement procedures, and full funding of the victims compensation fund.
