Probation staff expressed the unanimous view during this enquiry that the supervision of prisoners on ACR had not proved as difficult or problematic as had been anticipated. There were comparatively few breaches because supervising officers exercised discretion about reporting. The study highlighted several matters which could hinder enforcement of ACRs: (1) the status of ACR licenses outside England and Wales; (2) delay and difficulty in the execution of warrants; (3) the application of Police and Criminal Evidence Act 1984; (4) delays in issuing copies of licenses to the supervising Probation Officers; (5) lack of clear arrangements for supervising and issuing licenses to ACR prisoners in psychiatric hospitals, regional secure units and special hospitals; and (6) issuing incorrect licenses.
