Abstract
The first chapter is concerned with the effectiveness of the criminal and civil jury systems and the issue of secret versus open jury deliberations. The second chapter looks at whether the civil justice system needs reform and whether punitive damage awards should be limited. The third chapter considers the impact of litigation on court caseloads and on the competitiveness of businesses. The fourth chapter addresses the fairness of the criminal justice system, particularly with respect to racial discrimination, mandatory minimum sentences, civil forfeiture, victim involvement in criminal trials, and victim impact statements.
