This paper reviews the revised draft protocol against trafficking in persons, especially women and children at the eleventh session of the United Nations Ad Hoc Committee on the Elaboration of a Convention against Transnational Organized Crime.
Abstract
The revised draft protocol (legal instrument) in the prevention, suppression, and punishment of trafficking in persons, especially women and children, under item three of the provisional agenda, is presented in four sections containing a total of 18 articles. Section 1, Purpose, Scope and Criminal Sanctions contains Articles 1-3 focusing on the purpose of the protocol, the scope of the application, definitions within the protocol, the obligation to adopt measures necessary to criminalize. Section 2, Protection of Trafficked Persons contains Articles 4-6 focusing on the assistance for and protection of victims of trafficking in persons, the status of the victim in the receiving State permitting victims to remain in their territories, temporarily or permanently, and reparation of victims of trafficking in persons. Section 3, Prevention, Cooperation, and Other Measures contains Articles 7-11 with Article 12 being deleted. The articles focused on information and training measures for law enforcement, border controls in the detection and prevention of trafficking in persons, ensuring the quality of international travel documents, verification of legitimacy of travel or identity documents, the prevention of trafficking in persons, and the cooperation of States parties with non-States parties. Section 4, Final Provisions contains 8 articles focusing on the saving clause where protocol is consistent with international principles of non-discrimination; the settlement of disputes; the signature, ratification, acceptance, approval and accession of the protocol; the protocol's acceptance into force after the 14th article; amendments proposed 5 years after the protocol's acceptance into force, the denunciation of the protocol, and the depository or location of the original protocol and the languages of the protocol.
