This paper provides proposals and contributions received from various international governments on the international protocol (legal instrument) against the manufacturing of and trafficking in firearms, their parts and components and ammunition to the United Nations Ad Hoc Committee on the Elaboration of a Convention Against Transnational Organized Crime.
Abstract
This paper contains proposals and contributions, under item 5 of the provisional agenda, from 10 international governments on the finalization and approval of the international protocol against illicit manufacturing of and trafficking in firearms, their parts and components and ammunition. Australia, Norway, and Switzerland proposed under Article 11, General Requirements for Export, Import and Transit Licensing or Authorization Systems a revision be made in paragraph two dealing with the marking of firearms for export in accordance with Article 9. Canada proposed that Article 7, Confiscation or Forfeiture be amended. China proposed additional information be added to Article 9, Marking of Firearms, Article 11, General Requirements for Export, Import and Transit Licensing or Authorization Systems and Article 14, Exchange of Information. It was also proposed that modifications be made to the last sentence in Article 17, Confidentiality regarding State party notification. Columbia proposed an amendment to the introduction addressing the prevention and eradication of illicit firearm trade. Columbia also proposed new paragraphs and amendments to be added to Article 5, Criminalization, Article 8, on Record Keeping and the Sharing of Technology, Article 9, Marking of Firearms, Article 11, General Requirements for Export, Import, and Transit Licensing or Authorization Systems, Article 14, Exchange of Information, Article 15, Cooperation, Article 18, Registration and Licensing of Brokers. Japan proposed amendments to Article 2, Definitions, Article 6 Jurisdictions, and Article 7 Confiscation or Forfeiture. Malawi and Swaziland proposed an amendment to Article 2, Definitions. Norway proposed an amendment under Article 5, Criminalization. The Syrian Arab Republic proposed amendments under the introduction, Article 1, Relationship with the United Nations Convention Against Transnational Organized Crime, Article 5, Criminalization, Article 6 Jurisdiction, Article 7 Confiscation or Forfeiture, Article 8 Record Keeping, Article 9, Marking of Firearms, Article 15, Cooperation and the Establishment of a Focal Point, Article 16, Exchange of Experiences and Training, and Article 18 Registration and Licensing of Brokers. Turkey proposed an amendment under Article 2, Definitions. The United States of America proposed amendments under Article 2, Definitions, Article 5, Criminalization, and Article 18, Registration and Licensing of Brokers.
