THIS NOTE EXAMINES THE SCIENTIFIC CONTROVERSY SURROUNDING THE RELIABILITY OF SPECTROGRAPH IDENTIFICATION, AND ANALYZES THE EVIDENTIARY AND CONSTITUTIONAL QUESTIONS PRESENTED BY THE ADMISSABILITY OF VOICEPRINT EVIDENCE.
Abstract
THE THEORY BEHIND VOICEPRINT IDENTIFICATION AND THE POSSIBLE SOURCES OF ERROR INVOICEPRINT IDENTIFICATIONS ARE EXAMINED. SPECIFIC OBJECTIONS BY THE SCIENTIFIC COMMUNITY TO CLAIMS OF THE RELIABILITY OF VOICEPRINT IDENTIFICATION ARE ALSO DISCUSSED. A REVIEW OF CASES WHICH HAVE RULED ON THE USE OF VOICEPRINTS IS PRESENTED. FINALLY, EVIDENTIARY ISSUES AND QUESTIONS OF SELF-INCRIMINATION, RIGHT TO COUNSEL, ILLEGAL SEARCH AND SEIZURE, AND DUE PROCESS OF LAW RAISED BY USE OF VOICEPRINT EVIDENCE ARE DISCUSSED.
