IN THIS COLLECTION OF 20 ESSAYS, EXPERTS IN THE FIELDS OF LAW, PHILOSOPHY, AND POLITICAL SCIENCE DIRECT THEIR EFFORTS TOWARD ADVANCING AND REFINING UNDERSTANDING OF THE CONCEPT OF DUE PROCESS.
Abstract
THE ESSAYS PUBLISHED IN THIS VOLUME GREW OUT OF THE MEETING OF THE AMERICAN SOCIETY FOR POLITICAL AND LEGAL PHILOSOPHY IN DECEMBER 1973, HELD IN CONNECTION WITH THE MEETINGS OF THE AMERICAN ASSOCIATION OF LAW SCHOOLS. AFTER AN INTRODUCTORY CHAPTER, THE BOOK IS DIVIDED INTO THREE PARTS. THE FIRST SECTION IS DEVOTED TO HISTORICAL AND COMPARATIVE DIMENSIONS OF THE ISSUE OF DUE PROCESS. PART TWO COMPRISES SIX PAPERS EXPLORING THE NATURE AND RATIONALE OF DUE PROCESS FROM A VARIETY OF VIEWPOINTS, THE MORALITY OR ARBITRARINESS OF WHICH FORMS A BASIS FOR THE PRINCIPLE. THE THIRD PART OF THE BOOK CONSIDERS EXTENDED APPLICATIONS OF DUE PROCESS IN LEGAL CONTEXTS AND OUTSIDE THE COURTS OF LAW, SPECIFICALLY, THE 'DUE' IMPLEMENTATION OF THE MAJORITY RULE PRINCIPLE, THE PHILOSOPHICAL BASES FOR THE MAJORITY PRINCIPLE ITSELF, AND VOTING PROCEDURES FOR THE DISCOVERY OF MAJORITY RULE IN THE CONTEXT OF UNIVERSITY MANAGEMENT AND COLLECTIVE BARGAINING BETWEEN LABOR AND MANAGEMENT.
