A SERIES OF PAPERS EXPLORING THEORETICAL, POLITICAL, AND PRACTICAL PROBLEMS ASSOCIATED WITH PENAL JUSTICE IS PRESENTED.
Abstract
THESE PAPERS WERE DELIVERED AT A SYMPOSIUM ON 'CRIMINAL JUSTICE AND PUNISHMENT' HELD AT THE UNIVERSITY OF NEBRASKA IN 1976. THE 'JUST DESERTS' THEORY OR RETRIBUTIVISM DOMINATES THE PAPERS WHILE THE IDEA OF REHABILITATION IS DOWNPLAYED, REFLECTING ITS CURRENT FALL FROM THEORETICAL FAVOR. TOPICS COVERED INCLUDE: PUNISHMENT, PROTECTION, AND RETALIATION; CONCESSIONS TO RETRIBUTION IN PUNISHMENT; QUESTIONS OF JUST DESERTS; PHILOSOPHICAL CONSIDERATIONS OF CRIMINAL SENTENCING; THE POLITICAL FEASIBILITY OF PUNISHMENT; PURSUING JUSTICE IN CORRECTIONS; PUNISHMENT AND PRISONS; AND PROBLEMS WITH THEORIES OF PUNISHMENT. AN EXTENSIVE BIBLIOGRAPHY IS INCLUDED. SELECTED PAPERS HAVE BEEN ACCESSIONED SEPARATELY (SEE NCJ-43084 THROUGH NCJ-43090).
