STEPS TO INSURE THE PRIVACY AND SECURITY OF CRIMINAL HISTORY RECORD INFORMATION IN NEW YORK ARE SET FORTH.
Abstract
THE PLAN SPECIFIES THE EXTENT TO WHICH NEW YORK IS IN COMPLIANCE WITH FEDERAL REGULATIONS AND DEFINES THE ACTIONS THE STATE WILL TAKE TO BRING ITS CRIMINAL HISTORY RECORD COLLECTION, PROCESSING, STORAGE, AND DISSEMINATION PROCEDURES INTO FULL COMPLIANCE. THE STATUTORY AUTHORITY OF NEW YORK'S CENTRAL STATE REPOSITORY IS DEFINED, AND THE STATE'S DISPOSITION REPORTING SYSTEM IS DESCRIBED. PLANNED MODIFICATIONS TO THE SYSTEM ARE OUTLINED RELATIVE TO COMPLIANCE WITH THE 90-DAY RULE AND WITH THE REQUIREMENT FOR QUERY BEFORE DISSEMINATION. THE STATE'S REGULATIONS GOVERNING LIMITS ON ACCESS TO AND DISSEMINATION OF CRIMINAL HISTORY RECORDS ARE SET FORTH, AS ARE PROCEDURES FOR ASSURING THE SECURITY OF DATA HELD IN THE CENTRAL REPOSITORY AND FOR CONDUCTING AUDITS OF THE CENTRAL REPOSITORY'S INTERNAL PROCEDURES AND OF DATA USERS. A TIMETABLE FOR IMPLEMENTING THE STATE PLAN IS PROVIDED. APPENDED MATERIALS INCLUDE A DECEMBER 1974 DRAFT COPY OF THE STATE DIVISION OF CRIMINAL JUSTICE SERVICES PRIVACY REGULATIONS, SAMPLE COPIES OF THE STATE'S USE AND DISSEMINATION AGREEMENT AND NONDISCLOSURE AGREEMENT, THE STATE'S CERTIFICATION STATEMENT, AND OTHER SUPPORTING DOCUMENTATION.
