THE NEW PENAL CODE AND PROVISIONS FOR CORRECTIONAL MANAGEMENT AND POLICE REFORM CONTAINED IN THE 1974 JUSTICE REFORM OF PUERTO RICO ARE EXAMINED.
Abstract
THE OVERVIEW OF THE NEW PENAL CODE INCLUDES GENERAL PRINCIPLES, SPECIFIC CRIMES, AND COMPLEMENTARY MEASURES. THE SECTION ON THE CORRECTIONAL SYSTEM COVERS THE GENERAL PHILOSOPHY, FUNCTIONS, POWERS, AND OPERATION OF CORRECTIONAL ADMINISTRATION, CORRECTIONAL MANAGEMENT, AND THE PAROLE BOARD. ASPECTS OF POLICE REFORM, SUCH AS DISCIPLINARY MATTERS; PROMOTION, WORK DAY, AND LEAVE ARE PRESENTED IN A THIRD SECTION, AND SPECIAL CHAPTERS ON LEGAL PROTECTION OF CIVIL RIGHTS, LEGAL PROTECTION OF NEGOTIABLE DOCUMENTS (I.E., CHECKS AND CREDIT CARDS), AND ELECTORAL CRIMES ARE PRESENTED. APPENDIXES COVER THE SITUATION OF CRIME IN PUERTO RICO, BASIC RULES OF CONDUCT FOR THOSE INCARCERATED IN PUERTO RICAN PENAL INSTITUTIONS, AND AN ORGANIZATIONAL CHART OF THE PUERTO RICAN POLICE. --IN SPANISH.
