Abstract
THE DIVISION OF CONSUMER PROTECTION, WITHIN THE DEPARTMENT OF COMMERCE AND CONSUMER AFFAIRS, WAS ESTABLISHED BY THE STATE OF SOUTH DAKOTA TO PROTECT CONSUMERS FROM A VARIETY OF ILLEGAL PRACTICES WHICH CAN BE PERPETRATED ON THE CONSUMER. THIS GUIDE IS ONE SUCH EFFORT. GENERAL AND SPECIFIC GUIDANCE ARE GIVEN TO CONSUMERS SO AS TO HELP THEM PROTECT THEMSELVES FROM UNSCRUPULOUS MARKETING PRACTICES, AND CORRECTIVE MEASURES ARE SET FORTH FOR DEALING WITH SITUATIONS WHERE EXPLOITATION HAS OCCURRED. THE MARKETING AREAS CONSIDERED ARE UNSOLICITED MERCHANDISE; DOOR-TO-DOOR SALES; MOBILE HOMES; TRUTH-IN-LENDING; FAIR CREDIT REPORTING ACT; HOLDER IN DUE COURSE; INTEREST; WARRANTIES AND GUARANTEES; LANDLORD/TENANT; HOME IMPROVEMENT; NEW CAR/USED CAR; AUTO REPAIR SHOPS; SHOPPING BY MAIL; MAGAZINE SUBSCRIPTION SALES; AND CHARITIES. SELF-IMPROVEMENT SCHEMES ARE ALSO GIVEN CONSIDERATION. THE STEPS REQUIRED FOR BRINGING A SMALL CLAIMS COURT CASE ARE ALSO DELINEATED.
