THIS PROFILE OF THE NEVADA STATE COURT SYSTEM REVIEWS THE COURTS' STRUCTURE AND AUTHORITY, AND DETERMINES THE EXTENT OF THE SYSTEM'S COMPLIANCE WITH THE AMERICAN BAR ASSOCIATION'S STANDARDS.
Abstract
THE EXAMINATION OF THE NEVADA COURTS PREPARED BY THE NATIONAL CENTER FOR STATE COURTS IS BASED ON THE NEVADA STATUTES, THE STATE CONSTITUTION, AND THE COURT RULES, AS VERIFIED BY THE STATE COURT ADMINISTRATOR. THE OVERVIEW OF THE NEVADA COURT SYSTEM INDICATES THAT THE SYSTEM IS GENERALLY CONSISTENT WITH THE STANDARDS OF THE AMERICAN BAR ASSOCIATION (ABA) BY THE UNIFICATION OF ITS COURT STRUCTURE. CLOSER COMPLIANCE WOULD REQUIRE THAT THE TRIAL COURTS BE DIVIDED INTO GEOGRAPHIC DISTRICTS, AND THAT ALL JUDGES BE APPOINTED BY THE GOVERNOR FROM A LIST OF NOMINATED ATTORNEYS. WHILE NEVADA'S PROCEDURES FOR DISCIPLINE AND REMOVAL ARE PARTIALLY CONSISTENT WITH THE ABA STANDARDS, IT IS SUGGESTED THAT THE FINAL DECISION ON SUCH ACTION BE MADE BY THE SUPREME COURT OF NEVADA. FURTHER EXAMINATION INDICATES THAT THE VESTING OF ADMINISTRATIVE AUTHORITY IN THE CHIEF JUSTICE IS IN LINE WITH THE ABA RECOMMENDATION, BUT THE ABA SUGGESTION IS THAT THE CHIEF JUSTICE BE SELECTED BY PEER VOTE OR GOVERNOR'S APPOINTMENT SUBJECT TO CONFIRMATION BY THE JUDICIAL NOMINATING COMMITTEE. OTHER AREAS COMPARED WITH THE ABA STANDARDS INCLUDE COURT SYSTEM FINANCING, COURT RECORDS, AND THE SELECTION OF INFORMATION AND DATA PROCESSING SYSTEMS.
