THIS APPENDIX TO THE SENATE HEARINGS ON THE GRAND JURY REFORM ACT OF 1978 CONTAINS THE TEXTS OF THE BILL AND ITS AMENDMENT, AS WELL AS RELEVANT REFERENCE MATERIALS.
Abstract
THE TEXTS OF SENATE BILL 3405 AND AMENDMENT NO. 4736 ARE FOLLOWED BY A CONGRESSIONAL RESEARCH SERVICE (CRS) REPORT WHICH ANALYZES THE LEGISLATION ON A SECTION-BY-SECTION BASIS AND COMMENTS ON AMBIGUOUS OR INEFFECTIVE LANGUAGE. THE DIFFERING POSITIONS OF THE AMERICAN BAR ASSOCIATION (ABA) AND THE DEPARTMENT OF JUSTICE ARE DETAILED AND SUMMARIZED IN A CHART. THE APPENDIX CONTAINS A WIDE SELECTION OF ARTICLES ON GRAND JURIES REPRINTED FROM LAW REVIEWS, NEWSPAPERS, AND MAGAZINES. ADDITIONAL MATERIALS SELECTED BY THE ABA CONTAIN ITS POLICY STATEMENT AND INFORMATION ON STATES' REFORM LEGISLATION. SUPPLEMENTARY MATERIALS INCLUDE STATEMENTS AND PAPERS CONCERNING THE TREATMENT OF GRAND JURY WITNESSES; SURVEYS OF GRAND JURY PRACTICES ON A STATE AND FEDERAL LEVEL WRITTEN BY CRS; DOCUMENTS ON GRAND JURY REFORM IN MASSACHUSETTS, NEW JERSEY, AND NEW YORK; AND EXAMPLES OF GRAND JURY ABUSE. THE APPENDIX ALSO CONTAINS STATEMENTS FROM THE COALITION TO END GRAND JURY ABUSE, THE NATIONAL LAWYER'S GUILD, THE NEWSPAPER GUILD, THE CENTER FOR CONSTITUIONAL RIGHTS, AND THE INTERNATIONAL LONGSHOREMEN'S AND WAREHOUSEMEN'S UNION.
