THIS REPORT EXAMINES THE LEGAL RIGHTS AND OBLIGATIONS OF VOLUNTEERS AND ORGANIZATIONS UTILIZING VOLUNTEERS IN THE STATE OF GEORGIA.
Abstract
THE INCREASING LEVEL OF ACTIVITY OF VOLUNTEERS IN MANY ASPECTS OF COMMUNITY LIFE MAKES IT IMPORTANT TO EXAMINE THE LEGAL ASPECTS OF VOLUNTEERISM WITH A VIEW TOWARDS PREVENTION OF PROBLEMS. THE REPORT POINTS OUT AREAS WHERE LIABILITY IS POSSIBLE TO ASSIST VOLUNTEERS IN PLANNING THEIR CONDUCT AND TO ASSIST AGENCIES IN ESTABLISHING GUIDELINES TO MINIMIZE SITUATIONS IN WHICH PROBLEMS COULD OCCUR. AMONG THE SUBJECTS COVERED ARE LIABILITY OF VOLUNTEERS TO THIRD PARTIES FOR INJURIES OR DAMAGES RESULTING FROM VOLUNTEER WORK, LIABILITY TO THIRD PARTIES OF ORGANIZATIONS UTILIZING VOLUNTEERS FOR THE LEGAL WRONGS CAUSED BY VOLUNTEERS, LIABILITY TO VOLUNTEERS OF ORGANIZATIONS UTILIZING VOLUNTEERS FOR LEGAL WRONGS SUFFERED BY VOLUNTEERS, APPLICABILITY OF LABOR LAWS TO VOLUNTEERS, AND PERSONAL TAX CONSIDERATONS OF VOLUNTEERS. ALTHOUGH THE REPORT FOCUSES PRIMARILY ON THE LAW OF GEORGIA, THE ANALYSES AND CONCLUSIONS MAY BE RELEVANT IN OTHER JURISDICTIONS DUE TO THE GENERAL APPLICABILITY OF MANY OF THE PRINCIPLES DISCUSSED.
