THIS PROSECUTOR'S MANUAL IDENTIFIES AND DEFINES VARIOUS AREAS OF OFFICIAL CORRUPTION, DESCRIBES THE MANNER IN WHICH THESE SCHEMES ARE CARRIED OUT, AND SUGGESTS TECHNIQUES FOR CONDUCTING INVESTIGATIONS.
Abstract
VIEWS ARE ALSO PRESENTED ON THE RESPONSIBILITIES AND ROLE OF THE PROSECUTOR, THE FORMULATION OF POLICIES, AND THE EXERCISE OF PROSECUTORIAL DISCRETION IN CORRUPTION CASES. CERTAIN FRAUDULENT SCHEMES WHICH CARRY SPECIFIC CRIMINAL SANCTIONS ARE DISCUSSED, AND SAMPLE STATUTES ARE PRESENTED. THESE INCLUDE PROCUREMENT AND CONTRACT FRAUDS, FRAUD AND CORRUPTION IN GOVERNMENTAL REGULATION OF PRIVATE COMMERCE, THE MISAPPROPRIATION OF PUBLIC PROPERTY AND SERVICES, CORRUPTION IN GOVERNMENT FINANCE AND TAXATION, ELECTION FRAUD, AND CORRUPTION IN THE CRIMINAL JUSTICE SYSTEM. AS AN ALTERNATIVE TO PROSECUTION, CIVIL REMEDIES DISCUSSED INCLUDE REMEDIAL WRITS, THE RACKETEER INFLUENCES AND CORRUPT ORGANIZATIONS (RICO) STATUTE, PUBLIC NUISANCE LAWS, LICENSE REVOCATIONS, TAX VIOLATIONS, AND REMOVAL FROM OFFICE FOR MISCONDUCT. RELATIONS BETWEEN THE PROSECUTOR AND THE PRESS ARE ALSO NOTED.
