VIEWPOINTS EXPRESSED AT A SYMPOSIUM ARRANGED BY THE GEORGE WASHINGTON UNIVERSITY LAW REVIEW CONCERNING CRIMINAL CODE REFORM ARE PRESENTED.
Abstract
EXPPERTS CONTRIBUTING THEIR THOUGHTS AT THE SYMPOSIUM ARE A CAREER DEPARTMENT OF JUSTICE OFFICIAL, A UNIVERSITY PROFESSOR, ATTORNEYS, AND SENATOR EDWARD M. KENNEDY. THE GOAL OF THE SYMPOSIUM IS TO PROMOTE THOUGHT AND TO ENCOURAGE DEVELOPMENT OF THE PROPER QUESTIONS. SPECIFIC ISSUES ADDRESSED AT THE SYMPOSIUM INCLUDE IMPROVING THE WHITE-COLLAR CRIME FIGHTING EFFORT, STRIKING THE DELCATE BALANCE BETWEEN CRIMINAL LAW ENFORCEMENT AND THE FREE PRESS, AND DEFINING THE PROPER JURISDICTIONAL SCOPE OF THE FEDERAL CRIMINAL LAW. TWO PAPERS SHOW HOW THE NEW FEDERAL CRIMINAL CODE WOULD ENHANCE FEDERAL LAW ENFORCEMENT EFFORTS IN COMBATTING WHITE-COLLAR CRIME, ARGUING THAT EXISTING LAW IN CODIFIED FORM IS MISTAKENLY CRITICIZED AS A NEW EXPANSION OF FEDERAL AUTHORITY. ANOTHER PAPER DESCRIBES AND REFUTES THE ARGUMENTS RAISED BY PROPONENTS OF THE FREE PRESS AGAINST CERTAIN PROVISIONS OF SENATE BILL 1437. FINALLY, THE PROPER SCOPE OF FEDERAL CRIMINAL JURISDICTION IN THE NEW FEDERAL CRIMINAL CODE IS CONSIDERED IN TWO CONTRASTING VIEWPOINTS WHICH EMPHASIZE THE DANGERS OF EXPANSION AS OPPOSED TO THE HAPHAZARD NATURE OF FEDERAL JURISDICATION IN EXISTING LAW. MOST AUTHORS AGREE THAT TRULY COMPREHENSIVE CRIMINAL CODE REFORM REQUIRES ADHERENCE TO THE RECOMMENDATIONS OF THE BROWN COMMISSION, THE ORGANIZATION WHICH GAVE IMPETUS TO CURRENT REFORM EFFORTS.
