A PUBLICATION OF THE CRIMINAL LAW PROJECT OF THE NEW YORK UNIVERSITY SCHOOL OF LAW, THIS VOLUME ANALYZES THE HISTORY AND SCOPE OF PROSTITUTION AND PROVIDES A 10-POINT PROGRAM FOR REFORM.
Abstract
SOCIAL FACTORS INFLUENCING AN INCREASED SUPPLY AND DEMAND FOR PROSTITUTION ARE DESCRIBED IN THE INTRODUCTION AS WELL AS THE SCOPE AND DEFINITION OF PROSTITUTION AND THE REASONS FOR ITS REPRESSION. SUBSEQUENT CHAPTERS COVER THE HISTORICAL EVOLUTION OF PROSTITUTION CONTROL FROM THAT USED IN PRIMITIVE SOCIETIES TO THAT PRACTICED IN THE U.S. IN THE 20TH CENTURY; LEGAL CONTROLS AND THEIR IMPLEMENTATION IN THE U.S. ARE EXAMINED, AND A STUDY OF SEVERAL NATIONS' APPROACH TO CONTROLLING PROSTITUTION IS PRESENTED. OTHER CHAPTERS ANALYZE VARIOUS STUDIES OF PROSTITUTES AND DISCUSS THE ROLES OF PATRONS, PANDERERS, PIMPS, AND OTHER PROMOTERS. MOTIVES FOR CONTROLLING PROSTITUTION ARE EXAMINED, INCLUDING THE PROTECTION OF CONVENTIONAL MORALITY, CONCERN FOR THE PATRON AND FOR THE PROSTITUTE, CRIME PREVENTION AND CONTROL, JUVENILE PROTECTION, PUBLIC NUISANCE ABATEMENT, CONCERN FOR THE PROSTITUTE'S FAMILY, LIMITATION ON INCOME TAX EVASION, AND VENEREAL DISEASE PREVENTION. CONSTITUTIONAL PROVISIONS AFFECTED BY PROSTITUTION-RELATED CONTROLS ARE DISCUSSED ALSO. THE TEXT SUGGESTS THAT PROSTITUTION BE ACCEPTED AS A LEGITIMATE PART OF SOCIETY'S SOCIAL STRUCTURE, DISCUSSES ALTERNATIVES OF DECRIMINALIZATION AND LEGALIZATION, AND PROPOSES A 10-POINT PROSTITUTION CONTROL MODEL. THIS PROGRAM WOULD LEGALIZE PROSTITUTION, PERMIT SOLICITATION IN CERTAIN CENTERS, AND CEASE PROHIBITION OF BROTHELS UNLESS FOUND TO BE AN ACTUAL NUISANCE. JUVENILE INVOLVEMENT WOULD BE PROHIBITED. THE MODEL WOULD ALSO LEGALIZE LIVING OFF THE EARNINGS OF AN ADULT PROSTITUTE AND WOULD MODIFY ANTIPANDERING AND ANTIPROMOTION STATUTES. NO REGISTRATION OR HEALTH INSPECTIONS WOULD BE REQUIRED. INCOME TAX PAYMENTS WOULD BE MANDATORY FROM BOTH PROSTITUTES AND PROMOTERS. IN ADDITION, A COMMISSION SHOULD BE ESTABLISHED TO DETERMINE HOW EFFECTIVELY THESE REFORMS HAVE DEALT WITH THE MOTIVES BEHIND PRESENT PROSTITUTION CONTROLS. TABULAR DATA AND EXTENSIVE FOOTNOTES ARE GIVEN. APPENDIXES CONTAIN A STUDY QUESTIONNAIRE, 1878 PARIS AND 1911 BERLIN REGULATIONS ON PUBLIC PROSTITUTION, AND THE 1978 LYON COUNTRY (NEVADA) CODE, AND THE MODEL PROSTITUTION CONTROL ACT.
