This instructional packet concerning California Penal Code Procedures for law enforcement officers to follow in investigating possible homicides contains an audio cassette recording, a filmstrip, and paper-and-pencil tests.
Abstract
Few areas of law enforcement capture the imagination of new police offiers more than homicide crimes. The corpus delicti for murder crimes includes the unlawful killing of a human being or a fetus with malice aforethought, while the corpus delicti for manslaughter crimes includes the unlawful killing of a human being without malice. Voluntary manslaughter involves killings which take place in the heat of passion or during a quarrel. Involuntary manslaughter involves deaths occurring as the result of lawful acts which produce unlawful killings or occurring during the commission of unlawful acts which are less than felonies. Vehicular manslaughter may occur with or without negligence. The following are exceptions from liability for killing a fetus: (1) acts where fetuses are killed during therapeutic abortions, (2) by the actions of registered physicians, or (3) at the solicitation and with the consent of the mother. Intent to kill differentiates murder from other crimes in this category. Intent may be in the form of either express or implied malice. The package includes a workbook containing a unit overview and test questions. Additional activities and an instructor's answer key are also included. The materials are designed for individualized instructional use.
