Guidelines are presented for the purpose, composition, and operations of the South Carolina Department of Corrections Adjustment Committee, which has the responsibility to hear and dispose of accusations of inmate institutional rule violations.
Abstract
Specific responsibilities of the Adjustment Committee are to (1) review evidence for and against an inmate properly accused of an institutional rule violation, (2) decide upon the guilt or innocence of the accused inmate, and (3) determine the punishment for those found guilty. The Adjustment Committee is composed of five voting members, including the chairman. The hearing is to be chaired by an official from the regional administration or warden's immediate staff. No more than one member shall be from the security administration. The five members shall be completed from employees of prison industry, classification, treatment services, and support services. The guide describes the duties of the chairman of the Committee, as well as the duties of Committee members and the inmate representative. The hearing procedure is described in detail. Rules of evidence at the hearing are presented. As a general principle, the Committee shall admit evidence which is reliable testimony about the facts of the incident from which the charges have arisen. Due process procedures to be followed are also provided.
