In discussing issues of domestic violence, attention is given to why domestic violence is a criminal justice problem and how an effective legal system can assist the victim, as well as the characteristics of the parties involved, i.e., battered women and abusive men. The discussion is also devoted to why victims of domestic violence are reluctant to prosecute and how proper police response encourages the victim to take further action and discourages the abuser's violent behavior. In considering the provisions of the IDVA, the focus is upon the new court order of protection, notably, who is covered under the order and where a victim can obtain an order of protection. The description of law enforcement responsibilities under the IDVA reviews current Illinois law pertaining to an arrest without a warrant, followed by a discussion of issues pertaining to arrest for violation of an order of protection. Procedures are also outlined for maintaining data on an order of protection, reporting requirements, and victim assistance. In addition to presenting suggested police policy and procedures for compliance with the IDVA, limited law enforcement liability under the IDVA is considered. A sample order for police procedures under the IDVA is discussed, and various attachments are included.
