Five chapters discuss various aspects of solving business disputes, including commercial arbitration, automobile injury claims, international arbitration, and disputes in the textile and apparel industries and in the construction industry.
Abstract
An introduction discusses the practice of arbitrating commercial disputes, advantages of arbitration, who uses arbitration, the arbitration agreement, the standard arbitration clause and submission agreement, and the four steps involved in arbitration. These steps involve initiating an arbitration, selecting an arbitrator, preparing for the hearing, and presenting the case. For each specialized area discussed, information is given on the history of arbitration in that field, how a dispute is brought to arbitration, selecting an arbitrator, challenging an arbitrator for bias, how the hearing is conducted, a typical case, and the award. Chapter bibliographies are included. The appendix contains American Arbitration Association (AAA) rules, code of ethics, a checklist, significant court decisions, the U.S. Arbitration Act, the Uniform Arbitration Act, modern arbitration statutes, and a list of AAA regional offices.
