These 50 arbitration rules promulgated by the General Arbitration Council of the Textile and Apparel Industries address aspects of the organization for arbitration and matters pertinent to prehearing and hearing procedures.
Abstract
Suggested arbitration clauses are provided, followed by rules for the composition of the General Arbitration Council, agreement of parties, the tribunal, delegation of duties, and the panel of arbitrators. Rules for prehearing matters address initiation under an arbitration provision in a contract, expedited procedures of arbitration, initiation under a submission, change of claim, prehearing conference, number of arbitrators, arbitrator qualifications, and other issues pertaining to preparation for arbitration. Rules for the hearing itself cover adjournments, majority decision, order of proceedings, arbitration in the absence of a party, evidence, closing and reopening of hearings, waiver of oral hearings, time extensions, and other matters pertaining to awards and the relation of hearing outcomes to subsequent judicial proceedings. Rules are also provided for expedited procedures. Information is included for the administrative fee schedule, other service charges, postponement fees, and a refund schedule.
