These proceedings of the 1981 meeting of the National Academy of Arbitrators (NAA) contain approximately 20 papers addressing arbitration of labor disputes in the public and private sectors, with attention to grievance and interest arbitration, judicial attitudes toward arbitration, and trends in the United States, Canada, and the international scene.
Abstract
Following an address by the NAA's president on threats to contemporary arbitration, the first group of papers focuses on arbitration of job security and other employment-related issues for the unorganized worker. The next series of papers provide overviews of interest arbitration involving public employees in Australia, Canada, and New York City. Differing views of the arbitrator's authority in deciding remedies are presented, as is a critique of the problems encountered in Federal sector grievance arbitration. Other critical analyses of the arbitration process discuss arbitration of discrimination claims and Hawaii's laws limiting arbitrators' powers in collective bargaining disputes with public employees. In the interest arbitration area, papers explore the impact of cap laws that limit government spending on arbitration from both the management and arbitrators' perspectives. Other papers address the advantages and disadvantages of tripartite panels and the International Labor Organization, which has representatives from over the International Labor Organization, which has representatives from over 140 nations. References accompany most papers, as do comments from conference participants.
