This book presents the Law Enforcement Assistance Administration's (LEAA's) decisions on the principal legal issues that have arisen from claims under the Public Safety Officers' Benefit Act over the first five years of the Act's existence.
Abstract
The text of the Public Safety Officers' Benefits Act is first presented. The Act, which is an amendment to the Omnibus Crime Control and Safe Streets Act of 1968, provides benefits to survivors of certain public safety officers who die in the performance of duty. LEAA's Public Safety Officers' Benefits regulations follow the text of the Act. The remainder of the book is organized by claim topic and contains the legal opinions, agency determinations, and court decisions affecting each significant element of coverage and eligibility. The first section of claims pertains to the Act's definition of public safety officers. The personnel at issue in these claims are auxiliary police, conservation officers, constables, contractors, dogcatchers, emergency medical technicians, Indian tribal safety officers, mayors, meter patrol officers, private security officers, psychiatric aides, revenue officers, school crossing guards, and volunteers. Other topics covered under the claims are the definitions of personal injury, definition of line of duty, and definitions of eligible survivors. Miscellaneous claim issues cover intentional misconduct, suicide, postpayment claim, payment of interest, and judicial review.
