This report of the President's Commission on Model State Drug Laws presents six model State laws designed to provide citizens with protections and incentives to organize and work cooperatively with police, other government officials, and the private sector to counter drug trafficking at the neighborhood and community level.
Abstract
The Model Expedited Eviction of Drug Traffickers Act enables landlords, tenant organizations, and prosecuting agencies to evict drug dealers from neighborhood properties quickly and easily. Provisions of the Model Drug Nuisance Abatement Act develop a longstanding civil remedy, which historically has been used to close down bawdy houses and gin mills, to eradicate drug distribution in private or commercial premises. Citizens who live and work in the community become parties in the civil action. The Model Crimes Code Provisions to Protect Tenants and Neighbors provides for "stay-away" orders that allow police to arrest those convicted of drug offenses if they return to the location of their drug distribution offense. Under the Model Anti-Drug Volunteer Protection Act, volunteers who act to reduce drug use and trafficking in their communities are protected from personal liability for good-faith, nonmalicious conduct. Provisions of the Model Alcohol and Other Drug Abuse Policy and Planning Coordination Act institutionalize systematic coordination of State drug efforts. The Model Community Mobilization Funding Act emphasizes coordination between prevention, law enforcement, treatment, education, and community groups in the development of antidrug projects eligible for State funding.
