Intended for law school instruction, this second of two volumes on criminal procedure addresses trial procedures and sentencing.
Abstract
The chapter on charging discusses the grand jury and indictment, charging discretion, pleading and successive prosecutions, and joinder. A chapter on defense pleading considers notice of defenses and witnesses, speedy trial, guilty pleas, and motions to suppress. An overview of jury-related issues addresses venue and publicity, voir dire, and the death penalty. This is followed by a discussion of the roles and responsibilities of prosecution counsel and defense counsel. A chapter on the prosecution case examines privileges and immunities of witnesses, cross-examination, unavailable witnesses and hearsay, and the production of witness statements. An overview of the case for the defense encompasses defendant competence, the defendant as witness, co-defendants, and expert witnesses. Remaining chapters consider the verdict and sentencing. The discussions of the various issues are based primarily in cited U.S. Supreme Court decisions. Questions and notes accompany each topic of discussion.
