THIS REGULARLY PUBLISHED BULLETIN CONTAINS SUMMARIES OF LAWS PASSED BY GOVERNMENTS OF EACH MEMBER STATE OF THE COUNCIL OF EUROPE RELATING TO CONSTITUTIONAL, CRIMINAL, CIVIL, AND INTERNATIONAL MATTERS.
Abstract
IN 1975 SEVERAL COUNTRIES RATIFIED INTERNATIONAL TREATIES DEALING WITH CRIMINAL LAW. FRANCE RATIFIED THE SINGLE CONVENTION ON NARCOTIC DRUGS AND SET UP FRONTIER CONTROLS. FRANCE AND SWEDEN PUBLISHED THE EUROPEAN CONVENTION ON SUPERVISION OF CONDITIONALLY SENTENCED OR RELEASED OFFENDERS. FRANCE, SWEDEN, IRELAND, ITALY, AND GERMANY ENACTED AIRPORT SECURITY AND HIJACKING LAWS WHILE BELGIUM HAD SUCH LEGISLATION PENDING. SWITZERLAND SIGNED AN AGREEMENT WITH THE U.S. PROMISING MUTUAL LEGAL AID IN FINANCIAL MATTERS. IN THE AREA OF INTERNAL CRIMINAL AND PENAL LAW, AUSTRIA ENLARGED THE LEGAL PROTECTION OF THE INDIVIDUAL AND DECRIMINALIZED PETTY FINANCIAL OFFENSES CAUSED BY NEGLIGENCE. BELGIUM CLARIFIED PROVISIONS OF THE GAMBLING ACT, INCREASED PENALTIES FOR DRUG DEALERS WHILE OFFERING ALTERNATIVES TO SENTENCING FOR DRUG USERS WHO ARE NOT DEALERS, AND CHANGED THE THEFT LAW TO MAKE THE PLACE WHERE A CRIME WAS COMMITTED IMMATERIAL. BOTH BELGIUM AND SWEDEN ENACTED NEW THEFT LAWS MAKING THE THREAT OF VIOLENCE AN IMPORTANT CONSIDERATION IN IMPOSING SENTENCE. FRANCE TIGHTENED BANKING REGULATIONS TO DECREASE CHECK FRAUD, DECRIMINALIZED ABORTION UNDER CERTAIN CONDITIONS, AND MADE RADAR DETECTION DEVICES ILLEGAL. THE FEDERAL REPUBLIC OF GERMANY CODIFIED PROCEDURES TO BE FOLLOWED AFTER A MINOR TRAFFIC ACCIDENT. ITALY AND SWITZERLAND BOTH ENACTED STRONG ARMS CONTROL LAWS. BOTH FRANCE AND ITALY LEGISLATED MASSIVE PRISON REFORM INCLUDING: A STATEMENT OF PRISONERS' RIGHTS TO HUMANE TREATMENT; MANDATING RECREATIONAL AND EDUCATIONAL PROGRAMS; SETTING UP A CLASSIFICATION OF FACILITIES RANGING FROM MAXIMUM TO MINIMUM SECURITY CORRECTIONAL INSTITUTIONS; AND MAKING PROVISION FOR ALTERNATIVES TO PRISON SENTENCING. CYPRUS RULED THAT A SENTENCE MUST BE REDUCED BY THE PERIOD OF TIME THE PERSON HAS SPENT IN JAIL AWAITING TRIAL. ITALY ENACTED A SERIES OF LAWS DEFINING POLITICAL CRIMES AND PROVIDING PENALTIES FOR POLITICAL VIOLENCE. THE NORDIC COUNTRIES SIGNED A MUTUAL EXTRADITION TREATY. A NUMBER OF LAWS DEALING WITH MINOR OFFENSES WERE PASSED.
