THIS DOCUMENT OFFERS EXPLANATIONS OF IMPORTANT SECTIONS OF NORTH CAROLINA'S CONTROLLED SUBSTANCES ACT (ARTICLE 5 OF G.S. CHAPTER 90).
Abstract
FOR EACH SECTION OR SUBSECTION OF THE STATUTE DISCUSSED, CONSIDERATION IS GIVEN TO THE PARTICULAR ELEMENTS THAT MAKE A PERSON GUILTY OF THE SUBSTANCE-ABUSE OFFENSE, A DESCRIPTION OF THE PUNISHMENT, AND EXPLANATORY NOTES WHICH REFER TO EACH PERTINENT ELEMENT OF GUILT. EXAMPLES OF THE DRUGS LISTED UNDER THE DIFFERENT SCHEDULES OF THE CONTROLLED SUBSTANCES ACT ARE HEROIN, LYSERGIC ACID DIETHYLAMIDE, MESCALINE, PEYOTE, OPIUM, COCAINE, CODEINE, MORPHINE, CHLORHEXADOL, BARBITAL, PHENOBARBITAL, COMPOUNDS WITH MIXTURES OF NARCOTIC DRUGS, MARIHUANA, AND TETRAHYDROCANNABINOLS. SECTIONS OF THE STATUTE ANALYZED INCLUDE MANUFACTURE OF CONTROLLED SUBSTANCE, SALE OR DELIVERY OF CONTROLLED SUBSTANCE, CREATING COUNTERFEIT CONTROLLED SUBSTANCES, POSSESSION OF CONTROLLED SUBSTANCES, CONTINUING CRIMINAL ENTERPRISE, OBTAINING CONTROLLED SUBSTANCE BY FRAUD OR FORGERY, AND OPERATING DRUG TREATMENT FACILITY WITHOUT LICENSE. PROOF OF EXEMPTION FROM CONTROLLED SUBSTANCES ACT, PUNISHMENT FOR SECOND OR SUBSEQUENT OFFENSES, AND OTHER CONTROLLED SUBSTANCES OFFENSES ALSO ARE HIGHLIGHTED.
