IN FRANCE, THE TERM 'LEGAL PROTECTION' (PROTECTION JUDICIAIRE) REFERS TO MEASURES SUCH AS SOCIAL WORK, INSTITUTIONALIZATION, EDUCATION, OR SUPERVISION ORDERED BY THE COURT FOR MINORS OVER THE AGE OF 16.
Abstract
THE ARTICLE REVIEWS SOME OF THE MAJOR DEVELOPMENTS IN PROVIDING LEGAL MEASURES FOR THE PROTECTION OF DELINQUENT MINORS AND OTHER JUVENILES IN NEED OF SOCIAL INTERVENTION IN FRANCE SINCE WORLD WAR TWO. FACTORS DISCUSSED INCLUDE THE INFLUENCE OF SOCIAL SCIENCE, PHILOSOPHICAL, AND MEDICAL CONCEPTS CONCERNING CHILD DEVELOPMENT, THE USE OF CIVIL AS OPPOSED TO CRIMINAL JUSTICE MEASURES, AND THE EFFECTS OF 1958 FRENCH LEGISLATION REGARDING THE HUMAN RIGHTS OF THE SUBJECTS IN JUVENILE CASES. THE AUTHOR SETS FORTH SOME GENERAL CONDITIONS NECESSARY IN THE FRENCH SYSTEM OF JUSTICE IN ORDER TO PROPERLY DETERMINE JUVENILE CASES. INCLUDED IN THIS IS THE NEED FOR SPECIAL TRAINING OF JUDGES AND LAWYERS IN JUVENILE JUSTICE. --IN FRENCH
