AFTER A BRIEF REVIEW OF THE JURISDICTION AND STRUCTURE OF JUVENILE COURTS, THIS ARTICLE EXAMINES THE WAYS IN WHICH A MORE EFFECTIVE JUVENILE COURT SYSTEM WOULD PROMOTE DELINQUENCY PREVENTION.
Abstract
THE AUTHOR ARGUES THAT A STRONG, ACTIVIST, VISIBLE JUVENILE COURT - WHICH CAN TAKE THE TOOLS OF OPERATIONS RESEARCH AND MANAGEMENT SCIENCE TO IMPROVE ITS PLANNING, RESOURCE ALLOCATIONS, AND MANAGEMENT; AND WHICH STANDS FOR PREDICTABLE AND EVEN-HANDED JUSTICE - SHOULD BE A SIGNIFICANT FORCE FOR DELINQUENCY PREVENTION. HE MAINTAINS THAT IT IS THE ACTIONS OF THE COURT WHICH APPLY THE LABEL OF DELINQUENCY AND ENTER INTO THE RISK CALCULATIONS OF POTENTIAL OFFENDERS. HE CONCLUDES THAT IF THE COURT IS NOW INADEQUATE TO PREVENT OFFENSES, A WELL MANAGED, ACTIVIST COURT, WHICH CAN MANAGE THE JUVENILE JUSTICE SYSTEM IN ITS JURISDICTION SHOULD ADD SOMETHING TO DELINQUENCY PREVENTION.
